Is DALL-E 3 Illegal For Commercial Use?

Hey everyone! Welcome to a brand new article. I'll make this really quick and simple. Yesterday, I showed you how to create some images with DALL-E 3 integrated into ChatGPT. I've received questions recently about the legality and commercial allowances. Is it illegal? Is it not illegal? Is it allowed to use these images for commercial purposes?

DALL-E 3 is powered by OpenAI, which offers various products including DALL-E and ChatGPT, along with other things in development. OpenAI has clear terms of service that explain whether you can use it for commercial purposes.

In simple terms, I did a commercial purposes search and here's what it states: "You may provide input to the services and receive output generated and returned by the services based on the input. Input and output collectively are known as content. As between the parties and to the extent permitted by applicable law, you own all the input. Subject to your compliance with these terms, OpenAI hereby assigns to you all its rights, title, and interest in and to the output." This means you can use the content for any purpose, including commercial uses like sales or publications, as long as you comply with these terms.

So, are you allowed to make money off OpenAI products like DALL-E and ChatGPT? Absolutely! You can take these images, post them wherever you like, and do whatever you want. Of course, if you create a lemon sticker, your design might be similar to someone else's, so you might want to research that. But essentially, nobody owns the exact same design you have.

Looking at governmental laws behind copyright and trademark, it's straightforward. Anything produced by AI can't be owned by anyone, trademarked, or copyrighted. Therefore, you have full permission to use AI-generated content. Legally, a company can't restrict this because there's no legal backing to enforce such a restriction. Courts have ruled that AI-generated content can be used commercially whether it’s from ChatGPT, DALL-E, or any AI-related tool.

To sum up, yes, you can use these tools for commercial purposes. This should hopefully clear up any confusion. I've received multiple comments across various videos, all asking about this.
